Deal Breaker?
Supreme Court nominee Elena Kagan is receiving a mix of criticism and praise from both Republicans and Democrats.
What do you think? How do you feel about a nominee that lacks judicial experience?

I am more interested in what she will do after getting on the bench than before.It might even be a benefit!

If Thurgood Marshall is to be used as a barometer of success,(who had no judicial experience) she should be just fine.

The real question should be why an African American female WITH judicial experience was denied the opportunity?

There are many supreme court justices serving right now that didn't have any judicial experience. So I don't really see what the big deal is.

I agree with Jim. The pressure to seek out a white protestant female trumps the need for experience.

Contrary to popular belief, President Obama has proven to be one of the most moderate Democratic Presidents in recent memory. He could have made a much more left-leaning choice in a Supreme Court nominee if he were acting in the name of progressivism.
His choice in Kagan proves that it's hard to be a middle-of-the-road policymaker when the environment is strongly charged with partisan viewpoints. The result is the the Left and the Right will have complaints.
I don't know of too many judges who do not have biased social viewpoints. Clarence Thomas serves as a good example. The question on the table should be if Kagan understands the law in order to correctly interpret and apply the law's meaning in the cases presented to her. The lack of experience as a judge does not mean a person does not understand the law. Most constitutional scholars would agree.
But the current political environment doesn't allow for the question I stated earlier to be heard.
Obama might learn his lesson the next time around and stack the bench with Black Panthers (Laughing)...

Harder to pin down.Her views are somewhat suspect.She may not be the leftist that many expect.
