What's Your Take? Guilty or Not?

An Oklahoma reserve sheriff's deputy accused of fatally shooting a man he says he meant to subdue with a Taser pleaded not guilty today to a charge of second-degree manslaughter. At the hearing, the judge granted Robert Bates permission to go to the Bahamas for a family vacation. Attorneys for the victim Eric Harris stated that the  deputy  was not certified on the .357-magnum revolver he fired, and the personal weapon was not on the Tulsa sheriff's list of approved firearms.

What’s Your Take? Should Robert Bates be found guilty  of manslaughter or  was this just an unfortunate deadly accident?

This is just a damn shame. The man is dead. He should be in jail, not in the ground.I believe it was a mistake. But he is still responsible for this death. While he sets around his family and lies about being trained. This is a case of the old boy system.
